1.2 The following Terms and Conditions of Business apply to all orders made by you as a private customer in the online shop of liberalismartworld.com via email or regular mail.
The Business Terms and Conditions that apply are those that are valid at the point in time when the contract was concluded..
1.3 The Terms and Conditions of our customers do not apply unless we have expressly confirmed their validity in writing. This also applies to clauses that are not in conflict with our General Conditions of Purchase and Ordering. Rights that we are entitled to above and beyond these General Conditions of Purchase and Ordering according to general legal provisions remain unaffected.
2. Orders and Conclusion of Contract
2.1 Our products can only be sold to persons of the age of majority and of full legal capacity for private use in quantities suitable for a normal household.
2.2.The presentation of the products in the online shop does not represent a legally binding offer; it is a non-binding online catalogue. You place a binding order by clicking the order button for the articles in the shopping cart. An automated e-mail will confirm the receipt of your order together with the acknowledgement of your order directly after you have sent the order. This e-mail confirmation concludes the sales contract.
2.3 With your order, you declare that you have read and accepted the General Terms and Conditions of Business described here, along with our Data Privacy Policy and our Cancellation Policy.
3. Price
3.1 The prices indicated are in euros and include the sales tax currently applicable and other price components.
3.2 The prices on the day the goods are ordered apply, unless something else has been agreed on in writing. Earlier price lists and catalogues automatically become invalid with the announcement of any changes.
3.3 Our prices do not include postage and shipping costs. The prices for shipping are charged from the warehouse.
3.4 The website www.liberalismartworld.com targets private consumers and corporate clients.
4. Shipping Costs
4.1 The postage and shipping charges for orders delivered within Germany amount to € 4.95 per order. From an order value of € 50 and more, this charge no longer applies, i.e. delivery is free.
4.2 The postage and shipping charges for orders delivered to Switzerland amount to € 14.90 per order. From an order value of € 100 and more, this charge no longer applies, i.e. delivery is free.
4.3 The postage and shipping charges for orders delivered to other EU countries outside of Germany amount to € 14.90 per order. From an order value of € 100 and more, this charge no longer applies, i.e. delivery is free.
5. Delivery Conditions
5.1 We deliver worldwide.
5.2. We deliver to your home or shipping address. It is not possible to deliver to P.O. boxes or per general delivery. Insofar as not otherwise agreed, the order will be sent to the shipping address provided by the orderer.
5.3 . You will find notes on the availability of products on the product pages.
5.4 In the event of partial deliveries caused or offered by MOLA, the remaining part of the order will be shipped free of charge. Should the customer expressly wish a delivery to be divided and delivered differently, the postage and packaging fee will be charged for each partial delivery.
5.5 Should there be any changes in the expected delivery time after you have placed your order, you will be informed via e-mail. As a consumer, you have the right at any time to withdraw from your order or to make any changes at any time free of charge as long as nothing to the contrary has been agreed.
5.6 In the event that it is not possible to fulfil the contract, MOLA reserves the right to withdraw from the contract.
5.7 All packaging passes into the ownership of the customer.
6. Terms of Payment
6.1 Payment is to be made via invoice, in advance (money transfer) or via credit card (Visa, Mastercard, American Express, Diners Club, Discover and JCB).
6.2 Should you choose payment in advance, you will receive our bank details in the order confirmation. Payment of the invoice amount is then due within 10 days to our account. Should we not receive the amount after 10 days, we reserve the right to withdraw from the contract.
6.3 If you choose to pay via invoice, you will receive an invoice with the delivery of the goods. This requires that you have agreed to the storage of your data with your first order. Please transfer the invoice amount, including the date of the invoice and the invoice no. within 21 days after receipt without deduction. At the current time, we can only process orders from new customers on invoice up to an amount of € 25 per invoice; for larger orders or shipping to countries outside of Germany, please choose payment via money transfer in advance, PayPal or credit card. We apologise for any inconvenience.
6.4 Should you delay in payment, you will be charged 5% above the base lending rate in interest. We reserve the right to prove and charge any greater damages caused by delay accordingly.
6.5 Costs will be charged to your credit card account or your PayPal account once the order has been processed.
6.6 MOLA reserves the right, in individual cases or in the event of the decline of banks or service providers to pay, to fill the order via payment in advance only. In this case, the customer can accept these conditions or withdraw from the order.
6.7 Costs incurred by a cancelled payment transaction because a bank account is not covered or the customer has sent incorrect information will be charged to the customer.
7. Retention of title
All goods delivered by MOLA remain the property of MOLA until they are paid in full and all claims in connection with the order have been satisfied. This also applies to conditional claims.
8. Cancellation Policy
If you are a consumer, you have the legal right to cancellation in Germany according to Para. 312b, 312d, 355 of the German Civil Code. A consumer is any natural person that concludes a legal transaction for a purpose that cannot be attributed to either commercial or self-employed activity.
8.1 Cancellation Policy
You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

of your decision to cancel this contract by a clear statement (e.g. by email or mail). You may use the attached model cancellation form (cancellation-form/ PDF) , but it is not obligatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
8.2 Effects of Cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and not later than fourteen days after the day on which we are informed about your decision to cancel this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You shall bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9. Returns of Goods
If you want to withdraw from the contract and return the goods to us (also see our separate Cancellation Policy.), we request that you take note of the following:
- Please fill out the return form you received with the order.Or you may use the attached model cancellation form (cancellation-form/ PDF)
- Put it in with the order, which you return in the original packaging, if possible. Please use additional protective packaging.
- Attach the return sticker to the package. Please make sure that our original shipping sticker is no longer visible. Hand in the package at a local DHL shop. We will then take care of the rest.

If you want to return goods from several different orders, then please be sure to put all the corresponding return forms into the package. This will help us to process your return more quickly and easily.
You will get a confirmation of the receipt of your return via e-mail as soon as we receive it.

10.2 Failing to make the complaint or to contact us has no consequences for your legal warranty rights. But by doing so, you help us to make our own claims with respect to the shipper and/or the transport insurance.
11. Transfer of Risk and Guaranteee
11.1 The risk for consumers is transferred to the consumer when the goods are handed over by the transport company.
11.2 The guarantee period begins with the delivery of the goods and complies with the legal regulations.
12. Liability
12.1Subject to the following Section 12 Para. 2 and 3, claims for damages by the customer, regardless of the legal basis, and claims for compensation for expenses made in vain are limited in the amount to (a) with respect to damaged goods delivered to the amount of the price agreed upon for those goods and (b) otherwise excluded.
12.2 The limitation of liability according to Section 12 Para. 1 does not apply insofar as the cause of damage is due to a grossly negligent or intentional breach of obligation or at least a negligent breach of major contract obligations; in the case of a negligent breach of obligations, however, the liability is limited to the amount for typically foreseeable damages.
12.3 The limitation of liability according to Section 12 Para. 1 does further not apply for damages resulting in injury to life and limb or health, for liability according to the Product Liability Act or insofar as we have fraudulently concealed a deficiency or have taken over a guarantee as an exception.
13. Applicable Law
You can place your orders in German or in English. All clauses of these Terms and Conditions, all transactions and sales activities on the website www.liberalismartworld.com or regular mail are subject to private international law and the UN Convention on Contracts for the International Sales of Goods. This also applies to goods shipped over the border.
14. Confidentiality
14.1 We respect your privacy and treat all data referring to you with the utmost confidentiality. Please also refer to our Data Privacy Declaration.
14.2 At registration, the customer on the www.liberalismartworld.com website uses a registration form and chooses a password. The customer is instructed to keep this password secret and not to make it known to any third parties. You should take all the necessary steps to make sure that your password remains secret and is stored safely and you should contact us immediately if you have reason to believe that third parties know your password or that someone has gained unauthorized access to your password or if this is likely. You are responsible for making sure that your information to us is correct and complete and that you inform us accordingly of any changes with respect to this information. You can view and update much of the information you have given us, such as your account setting, in the “My User Account” section on the website.
14.3 If you want to place an order, we require your name, your private or business address, your e-mail address and, if you want to pay with your credit card, your card number, the security code and the expiry date. The information on your credit card is not stored on our website and your order is sent to our customer service in encrypted form.
